Information on processing of personal data

customers visiting the Website and/or purchasing products by the same (hereinafter referred to as “Customers” or “Customer”),of the following:

Emerald will process personal data supplied by the Customer through the Site in compliance with the principles of correctness, lawfulness and transparency and the protection of the Customer’s privacy.

Personal data supplied by the Customer shall be processed, within the limits of Legislative Decree196/2003, for the following purposes: collecting and implementing purchase orders and proposals from the Customer; shipping of products purchased by the Customer; managing returns in case of the Customer’s withdrawal; sending messages and information to the Customer about the Emerald’s business, as well as promotional information.

The processing of personal data can be carried out with paper and/or computerised methods.

The provision of data including name, surname, residential address, mailing address, e-mail address and telephone number is necessary in order to implement the purchase proposals brought forward by the Customer: refusal to supply such data may result in failure, incorrect or partial implementation of the sale.

The provision of other personal data requested during the purchasing procedure is optional and is necessary only for purposes not directly related to the implementation of the sale of products through the Site.

Personal data disclosing racial and ethnic origin, religious beliefs, philosophical or otherwise, political opinions, membership of parties, trade unions, associations or organisations with a religious, philosophical, political or trade union nature, as well as personal data disclosing health and sex life and health-related data are considered sensitive data. This data, together with judicial data are not required by Emerald and, if spontaneously supplied, will not be processed unless the Customer gives its prior express written consent.

The data controller of personal data supplied by the Customer is Emerald S.r.l., registered offices in Perugia, via Romana 17-19, Tax Identification Number/ VAT Number 02936280540.

Personal data may also be disclosed, by virtue of the consent expressed by the Customer, to third parties who have been appointed by Emerald to carry out the tasks required for the operation of the Site, the sale of products through said Site and for the sending of notifications to the Customers on its behalf.

The processing of data takes place at the registered offices of Emerald, at its secondary or operational offices and as well as at the premises of third parties referred to in the preceding paragraph.

The Customer can implement its rights in relation to the data controller at any time pursuant to article 7 Legislative Decree 196/2003, the complete text of which can be found here below for you convenience:

Art. 7 – Right to Access Personal Data and Other Rights

  1. The data subject has the right to obtain confirmation of the existence or lack thereof of personal information regarding them, even if not recorded, and their intelligible communication.
  2. The data subject has the right to obtain information regarding:
    a) the origin of personal data;
    b) the purposes and manner of processing;
    c) the method applied in case of processing carried out with the aid of electronic means;
    d) the identity of the data controller, data supervisors and the representative designated pursuant to Article 5 comma 2;
    e) subjects or categories of subjects to which personal data may be disclosed, such as designated managers within the State, managers or representatives.
  3. The data subject also has the right to obtain:
    a) the updating, correction, or, when necessary, integration of data;
    b) the cancellation, transformation into anonymous form or the blockage of data processed in breach of the law, including data that does not need to be stored in relation to the purposes for which the data was collected or subsequently processed;
    c) certification to the effect that notification has been supplied of operations as per letters a) and b), as regards their content, to those to whom the data was communicated or disseminated, except for the case where notification proves impossible or requires the use of means clearly disproportionate to the right being protected.
  4. The data subject has the right to contest in part or fully:
    a) for legitimate reasons, the processing of personal data even if relevant to the purpose of collection;
    b) the handling of personal data for the purpose of sending advertising or sales materials or for the carrying out of market research or for commercial communication purposes.
